Understanding North Carolina's Contributory Negligence Rule
North Carolina is one of only 4 states with pure contributory negligence. This harsh rule means if you are even 1% at fault for your accident, you recover NOTHING.
Insurance companies use this to their advantage, trying to blame you for any part of the accident. They'll claim you were speeding, distracted, or didn't look carefully - anything to shift even minimal blame to you and deny your claim entirely.
That's why you need experienced NC injury lawyers. We know how to prove 100% liability on the other party and defend against contributory negligence arguments. We've recovered millions for NC injury victims despite this challenging law.

Personal Injury Law Across North Carolina: Key Rules Every Injured Person Should Know
Pure Contributory Negligence
North Carolina is one of only four states that still follows the doctrine of pure contributory negligence, a rule that bars any recovery if the injured person is found even 1% at fault for the accident. Unlike most states that use comparative fault systems allowing partial recovery, NC insurance companies and defense lawyers aggressively investigate every aspect of the plaintiff's conduct in search of any contributory fault argument. Retain experienced legal representation before giving any recorded statement to an insurance adjuster, who may attempt to extract admissions that eliminate your right to recover.
Statutes of Limitations
The general statute of limitations for personal injury claims in North Carolina is three years from the date of the injury, established under N.C.G.S. § 1-52. For wrongful death cases, the deadline is two years from the date of death under N.C.G.S. § 1-53. Missing these deadlines permanently bars recovery, regardless of how serious the injuries are or how clear the other party's fault. Acting quickly also serves the practical purpose of preserving critical evidence. Surveillance footage is typically overwritten within 30 to 60 days, accident scenes are repaired or altered, and witnesses' memories fade. Our attorneys act immediately after being retained to issue preservation letters and begin evidence collection.
Insurance Coverage Requirements
North Carolina requires minimum auto liability coverage of $30,000 per person, $60,000 per accident, and $25,000 for property damage. Insurers are required to offer uninsured motorist (UM) and underinsured motorist (UIM) coverage, though policyholders may reject it in writing. When at-fault drivers carry only minimum coverage, UM/UIM coverage on the injured person's own policy often becomes the most important source of compensation. Our attorneys review all available insurance policies, including household members' policies and umbrella policies, to identify every possible source of compensation in each case.
Recoverable Damages
Personal injury plaintiffs in North Carolina may recover economic damages, including past and future medical expenses, lost wages, loss of earning capacity, and property damage. They may also recover non-economic damages such as pain and suffering, emotional distress, and loss of consortium. North Carolina does not cap compensatory damages in most personal injury cases. Punitive damages, capped at $250,000 or three times compensatory damages, are available in cases involving fraud, malice, or willful and wanton conduct. Vasquez Law Firm serves injured clients throughout NC, including Charlotte, Raleigh, Smithfield, Fayetteville, and surrounding communities, on a contingency fee basis.
