EAD Categories We Handle
Adjustment of Status (Category C09)
Filed concurrently with Form I-485. Allows work while your green card application is pending. Can be issued as a combo card with advance parole.
TPS Holders (Category A12/C19)
Employment authorization for Temporary Protected Status beneficiaries. Must be renewed with each TPS re-registration. Automatic extensions apply during re-registration periods.
DACA Recipients (Category C33)
Work permit issued with DACA approval. Must be renewed every two years with the DACA renewal. Filing early is critical to avoid gaps.
Asylum Applicants (Category C08)
Asylum applicants may apply for an EAD 150 days after filing their asylum application if no decision has been made. Processing may be affected by the asylum EAD clock.
VAWA Self-Petitioners (Category A16/C31)
VAWA applicants can obtain an EAD after USCIS issues a prima facie determination on their self-petition. This provides critical financial independence from the abuser.
Dependent Spouses (H-4, L-2, E-1/E-2)
Certain dependent visa holders are eligible for EADs. H-4 spouses of H-1B holders with approved I-140 petitions, L-2 spouses, and E-1/E-2 spouses can all obtain work authorization.
The EAD Application Process
1. Determine Your Category
We identify the correct EAD category based on your immigration status and ensure you meet the eligibility requirements
2. Prepare Form I-765
Complete the application with accurate information, supporting documents, photographs, and the applicable filing fee
3. File with USCIS
Submit the application to the appropriate USCIS service center. Some categories allow online filing through myUSCIS
4. Biometrics Appointment
Attend fingerprinting at a USCIS Application Support Center in Charlotte or Raleigh if required
5. Receive Your EAD Card
The card is mailed to your address upon approval. Present it to your employer for I-9 verification
Automatic 180-Day EAD Extensions
For many EAD categories, USCIS provides an automatic 180-day extension when you timely file a renewal before your current EAD expires. To benefit from this extension:
- Your renewal must be filed before the current EAD expires
- Your EAD category must be eligible for automatic extension
- Show your employer the I-797C receipt notice along with your expired EAD as proof of continued authorization
- The extension lasts 180 days from the EAD expiration or until USCIS decides the renewal, whichever comes first
STEM OPT Extension
F-1 students who graduated with a degree in a STEM field (science, technology, engineering, or mathematics) may be eligible for a 24-month STEM OPT extension in addition to the standard 12-month post-completion OPT. This provides up to 36 months of work authorization. Employers must be enrolled in E-Verify, and a formal training plan (Form I-983) must be completed.
