Smithfield Waivers of Inadmissibility Lawyers

Attorneys in Smithfield and Charlotte Helping Ineligible and Inadmissible Immigrants

There are many reasons that a foreign citizen might be found to be inadmissible or ineligible for a visa to enter the United States legally. It is even possible for a foreign national to be deemed inadmissible even if he or she is already here in the United States. However, options may be available that could allow ineligible or inadmissible immigrants to get a waiver to enter or remain in the U.S.

At the Vasquez Law Firm, PLLC, our lawyers are equipped to handle this highly complicated area of immigration law. With more than 35 years of combined legal experience, we know that making a mistake in the waiver process could have serious consequences, possibly including deportation. If you or a loved one has been deemed inadmissible by U.S. immigration officials, our team is ready and willing to provide the guidance you need.

Grounds for Ineligibility or Inadmissibility

The U.S. government maintains a number of standards for foreign citizens who want to live and work in the United States. Individuals who do not live up to such standards could be found inadmissible. A finding of inadmissibility could be based on factors such as a person's health, criminal history, immigration fraud, and previous illegal entry or presence in the U.S. While there are many possible grounds for a ruling of inadmissibility, the most common include:

  • The person has a diagnosed physical or mental illness that is associated with dangerous actions or behavior.
  • The person has two or more criminal convictions and was imprisoned for at least five years.
  • The person knowingly gave false information during the application process for a visa or a green card.
  • The person has been removed or deported at least once before.
  • The person entered the U.S. illegally or continued to remain in the U.S. on a visa that was expired.

Charlotte, North Carolina Attorneys Can Help You Get a Waiver

If you or a family member has been found inadmissible, our attorneys can help you determine if a waiver of inadmissibility is possible for your situation. Waiver eligibility depends on many factors, including the basis for the original determination. When you choose our firm to help with your case, our lawyers will sit down with you to review your case and to analyze your options. If a waiver is possible, we will help you complete the Form I-601: Application for Waiver of Grounds of Inadmissibility. Depending on the circumstances, the application could be filed along with a petition for an Adjustment of Status or during proceedings for deportation. If the person in question is not in the United States currently, the waiver application can be filed with the visa application.

Once the waiving application is filed, the United States Citizenship and Immigration Services (USCIS) will review the submitted information, as well as the severity of the finding of inadmissibility. We cannot guarantee that USCIS will grant a waiver, but we can help you build a case that maximizes your chances of success. This could include showing that denying your waiver will result in extreme hardship for a lawful permanent resident or U.S. citizen family member. Refugees, asylum seekers, and those who have been victims of serious crimes or domestic violence could also qualify for waivers of inadmissibility.
