One of the most common types of family-based immigration is the K-1 fiancé visa. If you are a foreign national engaged to a U.S. citizen, your fiancé will need to petition to sponsor you for this visa, which will allow you to come to reunite with them in the U.S. However, simply being engaged to a U.S. citizen is not enough proof to obtain a fiancé visa.

What Is a Fiancé Visa?

The K-1 visa is a non-immigrant visa that allows a U.S. citizen to bring his or her fiancé to the country with the intention of getting married within 90 days. After you have gotten legally married, the foreign citizen can request an adjustment of status to obtain a green card. There are other restrictions that may apply and you will need to be prepared to prove the authenticity of your relationship.

Qualifications for the K-1 Visa

It can be very confusing and time-consuming to try to apply for a fiancé visa on your own, especially without knowledge of immigration law. We are here to ensure your paperwork is handled correctly and reduce or eliminate the chance of your application being denied.

How to Apply for a K-1 Visa

To apply for a K-1 Visa, you must file the Form I-129F, Petition for Alien Fiancé(e), with the USCIS. The processing time is not guaranteed. It may vary because it simply depends on a case-by-case basis, however, you can visit the USCIS website for the status of your petition anytime. When it is approved, the visa petition is sent to the National Visa Center (NVC). You will receive a case number when they send the petition off to the U.S. Embassy or Consulate where your fiancé lives. The next step is to actually apply for the visa.

Apply for the Visa

The NVC will contact you (the sponsor) via mail when the case is sent to the Embassy or Consulate. You must notify your fiancé of the next steps to apply for the K-1 visa per the letter and prepare for the interview.

In order to qualify for a K-1 visa, you must:

  • Have met your fiancé in person at least once within two years
  • Be a U.S. citizen to petition for your fiancé
  • Both be free to enter into a legal marriage
  • Have enough income to pay the affidavit of support
  • Prove that your relationship is genuine

    What Documents are Needed for the K-1 Visa?

    Be aware that some documents are required for the application:

    • Form DS-160, Online Nonimmigrant Visa Application
    • Original birth certificate that is translated into English
    • Current passport and 2 passport-style photos
    • Divorce certificates of previous spouse(s), if applicable. These must also be translated into English.

    It is possible that the consular officer will request additional information or documents from you to prove your relationship with your US citizen fiancé is genuine. Make sure you have easy access to your records during this process.
