Ways to Obtain Permanent Residency

There are several different ways which foreign nationals can go about applying for a green card. The most common way is through a family member.

Additionally, permanent residence can often be obtained through:

  • Employment
  • Investment
  • Asylum
  • Refugee status

An applicant for permanent residency can often begin with a non-immigrant visa – such as an H-1B or L-1A – and then, if qualified to do so, may apply for permanent residence. If this process applies to you, our Charlotte immigration attorney can help you with every step.

How do I Apply for a Green Card for My Family?

Most steps in applying for a green card for family members involves the petitioner (sponsor), while the last step mentioned in this list is completed by the immigrant.

The steps to applying for a green card for family are:

    1. File a Visa Petition (USCIS Form I-130).
    2. USCIS decides on the Visa Petition.
    3. Wait for Visa availability (for preference relatives only).
    4. Immigrant applies for an Immigrant Visa or Green Card.

Filing the Form I-130 involves a fee and additional documents may be requested to prove your relationship with the immigrant such as a birth or marriage certificate and proof of resident status. If you are a widow, an abused spouse, or a child of a US citizen, you may complete a self-petition with a Form I-360. Be aware that it may take anywhere between several months or several years for USCIS to approve the petition.

If it is approved, the immigrant’s case file will be forwarded to the National Visa Center (NVC) for further processing. However, if it is denied, you can find out the reasons for denial. If it is fixable, you can file a new petition.
